These Terms & Conditions (“Terms”) govern your participation in the Smoke Show subscription program offered by Athena Enterprises, LLC (“Smoke Show,” “we,” “us,” or “our”). By submitting a request on our website, accepting a quote, or paying an invoice, you agree to these Terms and our Privacy Policy.
1. Program overview
Smoke Show provides smoke shops with a turnkey adult novelty program that may include a branded display case, initial product load, and recurring monthly inventory refills at the tier selected (Starter, Standard, or Premium). Program details, pricing, and included products are described on smokeshowtoys.com and on your quote or invoice.
2. Initial 3-month commitment
New enrollments include an initial 3-month program commitment at the monthly tier price selected. Your first invoice covers the agreed program schedule (display, initial inventory, and scheduled monthly refills) as described on your quote or invoice.
By placing an order or paying your first invoice, you authorize charges according to the billing schedule shown on your invoice.
3. Cancellation
You may cancel your subscription after the initial 3-month commitment period has been fulfilled by contacting us at billing@smokeshowtoys.com. Cancellation takes effect at the end of the current billing cycle following our confirmation.
Early cancellation during the initial 3-month commitment period may require payment of remaining amounts due under your agreed program, unless otherwise agreed in writing.
4. Orders, quotes, and payment
- Quotes are valid for the period stated on the quote (typically 30 days).
- Payment is due according to the dates on your invoice. First payment is typically due upon receipt.
- Payments are processed through SBC Training LLC via our authorized payment provider. Your card statement may show “SMOKESHOW / SBC Training LLC.”
- By paying an invoice or submitting a program order, you confirm that you accept these Terms and agree to the subscription program described on your quote or invoice.
5. Display equipment
Display cases provided as part of the program remain the property of Smoke Show unless otherwise agreed in writing. If you cancel, we may arrange return of display equipment or apply terms communicated at enrollment. Product already shipped and paid for is yours to sell.
6. Shipping and inventory
We ship to the verified business address on your account. Refill quantities and product mix are based on your selected tier. We may substitute comparable products when necessary due to availability.
7. Retailer responsibilities
You are responsible for complying with all federal, state, and local laws governing the sale of adult novelty products, including age verification, signage, licensing, and placement requirements in your store.
8. Text messaging (SMS)
By checking the SMS consent box on our website or otherwise providing express consent, you agree to receive recurring text messages from Smoke Show at the mobile number you provide, including transactional and informational messages about your inquiry, account, orders, billing, shipments, and program updates.
- Consent — Consent is not required as a condition of purchase. You may opt in through the checkbox on our signup form or through another written agreement with us.
- Message frequency — Message frequency varies. You may receive several messages per month depending on account activity and outreach.
- Rates — Message and data rates may apply.
- Opt out — Reply STOP or UNSUBSCRIBE to any promotional message to opt out. We will process your request promptly. Opting out of promotional messages does not prevent important service-related texts about an active order or account.

By using our services and opting in to SMS, you acknowledge that you have read our Privacy Policy, including how we collect, use, and protect your information and how we do not share mobile opt-in data with third parties for marketing.
9. SMS delivery disclaimer
Smoke Show is not responsible for delays, failures in delivery, or other issues related to the transmission or receipt of text messages. Delivery is subject to your mobile carrier and is not guaranteed. Wireless carriers are not liable for delayed or undelivered messages. SMS services are provided on an “as is” basis without warranties of any kind, express or implied.
10. Limitation of liability
To the fullest extent permitted by law, Smoke Show is not liable for indirect, incidental, special, or consequential damages arising from your use of the program. Our total liability for any claim related to the program is limited to the amounts you paid to us in the three months preceding the claim.
11. Changes
We may update these Terms from time to time. The updated version will be posted at smokeshowtoys.com/terms with a revised “Last updated” date. Material changes will apply to new orders after posting unless otherwise required by law.
